Check Deadlines
Look up your state’s lien filing deadlines. Typically 60–90 days after last day of work
Prelim Notice
Some states require a preliminary notice before filing. Check your state’s rules
File Lien
File with your county recorder. Include property address, owner name, amount owed, and your signed change order
Serve Owner
Send a copy via certified mail. This is when most people suddenly find the money
Enforce / Release
They pay? File a release. They don’t? You can foreclose. Consult an attorney at this stage
For amounts under your state's limit (typically $5,000–$10,000), small claims court is fast, cheap, and you don't need a lawyer.
File Claim
Fill out the small claims form at your local courthouse. Fees are usually $30–$75
Serve Defendant
Formally notify the client via certified mail or process server
